GENERAL TERMS AND CONDITIONS OF SALE – Dimitile Hotel & Spa These general terms and conditions of sale are intended to govern the business relationships between Amanta (hereinafter referred to as “Dimitile” or “Hotel”) and its customers.

Preamble These General Terms and Conditions of Sale apply to individual bookings made by the customer for their personal needs. The booking request implies adherence to these sales conditions and full and unreserved acceptance of their provisions. The booking request must be made in the name of one of the people who will stay at the Hotel (hereinafter referred to as the “Customer”). The customer acknowledges having read and accepted these general terms and conditions of sale and the sales conditions of the reserved rate accessible on the website. The customer declares having the capacity to contract, that is to say being of legal age and not being under guardianship or trusteeship. The customer’s agreement regarding the general terms and conditions of sale and the sales conditions of the reserved rate occurs at the time of booking; no booking is possible without this agreement. The payment made during a booking for which the sales conditions of the rate do not allow the modification and cancellation of the booking, will be hereinafter called the prepayment.

Article 1: Booking The booking is deemed to be formed when the bank details are validated. The customer can book on the website, individually, and for their personal needs a limited number of rooms per booking and on a single mobile service. The customer undertakes, prior to any booking, to complete the information requested on the booking request. The customer certifies the truth and accuracy of the information transmitted. The booking procedure includes the following steps: step 1: choice of room and rate; step 2: selection, if applicable, of one or more additional services; step 3: verification of the details of the booking, its total price, the applicable sales conditions and possible adjustment of the choice (room, rate, additional service); step 4: entering the customer’s contact details; step 5: entering the credit card in case of guarantee request or prepayment step 6: consultation and acceptance of the general terms and conditions of sale and the sales conditions of the reserved rate before validating the booking; step 7: validation of the booking by the customer. The Hotel acknowledges receipt of the customer’s booking by sending an email to the customer without delay at the email address he previously entered summarizing the contract offer, the reserved services, the prices, the sales conditions related to the selected rate, accepted by the customer, the date of booking made.

Article 2: Cancellation conditions The customer is reminded, in accordance with article L. 121-20-4 of the Consumer Code, that he does not have the right of withdrawal provided for in article L. 121-20 of the Consumer Code. The sales conditions of the reserved rate specify the cancellation and/or modification conditions of the booking. Bookings with prepayment cannot be modified and/or cancelled. The advance payments that are the deposits will not be refunded. In this case, it is mentioned in the sales conditions of the rate. When the sales conditions of the reserved rate allow, the cancellation of the booking can be made directly on the website or the mobile services through the “Consult or cancel your booking” section. In case of interruption of the stay (unexpected departure) the client will also have to pay for the night of his departure. In the case of booking with prepayment, no refund will be made. Unless otherwise expressly stated, rooms are available from 14:00 on the day of arrival and the customer must vacate the room before 11:00 on the day of the end of the booking. Late check-out is possible on request, depending on room availability and at an additional charge.

Article 3 – Prices Prices are indicated in euros. The prices take into account the VAT applicable on the day of the order and any change in the applicable VAT rate (10%) will automatically be reflected in the prices indicated on the date of invoicing. The prices indicated only include the services strictly mentioned in the booking. To the price mentioned in the booking will be added, at the time of invoicing, the additional services provided by the hotel during the stay and the tourist tax. The applicable prices are those in force on the day of booking. Only the price indicated in the booking confirmation is contractual.

Article 4: Payment methods Payment for all services will be made directly to the hotel (except for reservations pre-payable at the time of booking). The possible payment methods are as follows:

  • Cash
  • Credit card
  • Leisure pass
  • ANCV
  • Restaurant ticket (restaurant only)
  • KDOPAYS checks

Article 5: Displacement In case of force majeure, exceptional events or technical problems in the hotel making the client’s stay impossible, the hotel will make every effort to find alternative accommodation, if possible in a hotel of the same category or higher category. The possible additional cost of the room and the journey between the 2 hotels will be borne by the hotel.

Article 6: Stay at the hotel The customer is asked to fill in an arrival form when they arrive at the hotel. To do this, the customer will be asked to present an ID to verify their identity. The hotel reserves the right to cancel the booking if the customer does not present an ID. The customer agrees and undertakes to use the room in a reasonable and appropriate manner. Any behaviour contrary to good morals and public order will lead the hotelier to ask the customer to leave the establishment without any compensation and or without any refund, if a payment has already been made. In the case where no payment has yet been made, the customer will have to pay for the nights consumed before leaving the establishment. The customer agrees that the computer resources (WIFI access) made available by the hotel will not be used in any way for illegal purposes. The customer is also obliged to comply with the security policy of the hotel’s internet service provider, including the rules for using the security measures implemented to prevent the illegal use of computer resources and to refrain from any act that could damage the effectiveness of these measures. The customer will be held responsible for any damage, any degradation, any act of vandalism that could occur as a result of the occupation of the premises and/or as a result of the participants and/or staff for whom he or she is responsible, both for property damages resulting from the use of the Internet network such as loss of data, viruses, service breakdown. We do not accept pets. It is not allowed to smoke or vape inside the hotel rooms. In case of non-compliance, the customer exposes himself to a penalty corresponding to the closure and complete cleaning of the room.

Article 7: Complaints Any complaint must be addressed to the hotel or by registered letter with acknowledgement of receipt, no later than 15 calendar days after the departure date, under penalty of forfeiture.

Article 8: Responsibilities The photographs presented on the site are not contractual. Even if all the best efforts are made to ensure that the photographs, graphical representations and texts reproduced to illustrate the hotels presented give as accurate an overview as possible of the accommodation services offered, variations may occur, particularly due to changes in furniture or possible renovations. The customer cannot claim any compensation for this. The hotel cannot be held responsible for non-performance or poor performance of the booking in case of force majeure, third party action, unforeseeable and insurmountable action of the customer or their partners, such as unavailability of the internet network, inability to access the website, external intrusion, computer viruses or in case of unauthorized prepayment by the cardholder’s bank.

Article 9: Respect for privacy and protection of personal data The Hotel implements personal data processing, for which it is responsible. As part of this processing, the Hotel collects information regarding the client’s identity, their email and/or postal address, their telephone number, the credit card information necessary for the payment of the room and other information related to specific client requirements. The customer is informed, on each of the personal data collection forms, of the mandatory or optional nature of the responses by the presence of an asterisk. Any service will be recorded and accessible by the client upon simple request at the following address: contact@hotel-ledimitile.com. In accordance with Law 78-17 “Informatique et Libertés” of January 6, 1978, as amended, and the General Data Protection Regulation, which came into force on May 25, 2018, the client has a right of access, rectification, and opposition to the personal data being processed concerning them. The customer can also refuse the processing, request a limitation of it or request the deletion (within the legal retention periods) of personal data. This right can be exercised on simple written request to the email, which will respond to the requests made. The purpose of the processing of the personal data collected corresponds to the obligations related to the services performed (customer management, commercial prospecting, statistics). Some personal data may be collected for services provided by the Hotel’s service providers for the purpose of booking or executing the contract, hotel booking, quality control management, claims (D-Edge APALEO). These service providers have their own privacy policies. We decline any responsibility for their policy or the processing of personal data.

Article 10: Applicable law – language These general terms and conditions of sale are governed by French law. The language of record is French. If the general terms and conditions of sale were to be translated into a foreign language, French will prevail over any other translation in case of dispute, litigation, difficulty in interpreting or executing these conditions and more generally concerning the existing relations between the parties.

Article 11: Evolution/modification of the general terms and conditions of sale by Internet These General Terms and Conditions of Internet Sales may be modified and/or supplemented at any time. As soon as it is put online on the internet, the new version of the General Terms and Conditions of Internet Sales will automatically apply to all customers.
